1. About Gylder
Gylder is a personal net worth tracking tool. It allows you to connect financial accounts and view your aggregated net worth in one place. Gylder is operated by [LEGAL: insert legal entity name, address, KvK number].
Gylder is not a financial adviser, broker, or investment manager. The information displayed is based on data retrieved from connected accounts. It is provided for informational purposes only and does not constitute financial, investment, tax, or legal advice. Gylder makes no guarantees about the accuracy, completeness, or timeliness of the data shown. Do not make financial decisions based solely on information displayed in Gylder.
2. Eligibility
- You must be at least 18 years old to use Gylder.
- You must be a resident of the European Union or European Economic Area.
- You must have the legal right to connect each account you link to Gylder.
[LEGAL: Confirm whether non-EEA users are permitted. If Gylder is only targeting NL initially, consider restricting sign-ups by geography. Verify age verification requirements.]
3. Your account
You are responsible for keeping your Gylder login credentials secure. You must notify us immediately at hello@gylder.com if you suspect unauthorised access to your account.
You are responsible for the accuracy of manual entries you add (real estate values, loan balances, etc.). Gylder does not verify manually entered data.
4. Subscriptions and billing
Free trial
New accounts receive a 30-day free trial on the Basic or Pro plan, depending on your selection at signup. No payment is taken during the trial. If you cancel before day 30, you will not be charged. After the trial, your account moves to read-only mode until you subscribe.
Subscription plans
Subscriptions are billed monthly or annually as selected. Annual subscriptions are non-refundable once the billing period has started — access continues until the period ends. Monthly subscriptions can be cancelled at any time; access continues until the end of the current billing month.
All prices are shown excluding VAT. EU VAT is applied at checkout based on your country of residence.
Cancellation
Cancel at any time from Settings → Subscription. Cancellation takes effect at the end of the current billing period. Your data is preserved and remains accessible in read-only mode after cancellation.
Downgrades
If you downgrade to a lower plan and have more connected accounts than the plan allows, you will be asked to choose which accounts to keep active. Inactive accounts are paused — their data is preserved.
[LEGAL: Verify refund policy complies with Dutch consumer law (Wet koop op afstand / Consumer Rights Directive). Digital services have specific cancellation right rules — confirm whether the 14-day cooling-off period applies and how to handle it. Confirm VAT handling with your accountant.]
5. Early Goose — founding member programme
The Early Goose programme is a one-time payment that grants 6 months of Pro access when Gylder launches. By purchasing Early Goose, you agree to the following:
- Payment is taken immediately at purchase. Access begins when Gylder enters public Alpha.
- Early Goose spots are limited to 20. Once sold out, this programme closes.
- If Gylder Alpha is not live by [LEGAL: insert firm deadline date — commit to a specific date], you are entitled to a full refund, no questions asked. Contact hello@gylder.com.
- After your 6 months of Pro access, your account continues on the Free plan unless you subscribe to a paid plan.
- Early Goose is non-transferable.
[LEGAL: This section creates a specific contractual obligation (refund if not live by deadline). Confirm the deadline date. Confirm how the refund will be processed via Stripe. Verify this does not constitute a regulated financial instrument or pre-sale under Dutch law. Consider whether the Early Goose purchaser has consumer rights that override any terms here.]
6. Acceptable use
You may not use Gylder to:
- Connect accounts you do not own or have authorisation to access.
- Attempt to reverse-engineer, scrape, or extract data from the service.
- Circumvent security measures or rate limits.
- Use the service for any unlawful purpose.
7. Availability and data accuracy
Gylder aims for high availability but does not guarantee uninterrupted service. Data shown in Gylder depends on third-party APIs (banks, exchanges, providers). Gylder is not responsible for delays, errors, or inaccuracies originating from those providers.
Exchange rates used for currency conversion are indicative and may differ from rates offered by banks or brokers.
8. Limitation of liability
To the maximum extent permitted by applicable law, Gylder and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to financial loss, data loss, or decisions made based on information displayed in Gylder.
Our total liability to you for any claim arising from these terms or use of the service shall not exceed the amount you paid to Gylder in the 12 months preceding the claim.
[LEGAL: Dutch consumer law limits what liability exclusions are enforceable against consumers. Review Art. 6:233 BW and consumer contract unfair terms rules. The cap on liability may not hold in all jurisdictions. Have a lawyer review this section.]
9. Termination
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. If we terminate your account without cause, you will receive a pro-rata refund for the unused portion of any prepaid subscription.
You may delete your account at any time from Settings → Data → Delete Account. Upon deletion, all your personal data is permanently removed (crypto-shredded). This action is irreversible.
10. Changes to these terms
We will notify you by email at least 30 days before any material changes to these terms take effect. Continued use of Gylder after that date constitutes acceptance of the updated terms.
11. Governing law and disputes
These terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in [LEGAL: insert city — typically the court where the company is registered], unless you are a consumer with rights to bring proceedings in your country of residence.
[LEGAL: Confirm jurisdiction clause. For EU consumers, Regulation 1215/2012 gives consumers the right to sue in their home country — your choice of jurisdiction clause will not override this right. Consider whether to include an ADR (Alternative Dispute Resolution) clause, which is required for some sectors under EU law.]
